1. Agreement to these terms

These Terms of Service (the “Terms”) govern your access to and use of Throngwatch (the “Service”), operated by Individual Entrepreneur Arsenii Maksymenko (“we”, “us”). By creating an account or using the Service, you agree to these Terms and to our Privacy Policy. If you do not agree, do not use the Service.

2. The Service & eligibility

The Service ingests activity from Discord servers you connect and presents analytics in a dashboard. To use it you must be old enough to form a binding contract in your country and to hold a Discord account under Discord’s own terms. You must not use the Service if we are barred from offering it to you under applicable law.

3. Your account

You are responsible for the accuracy of your account information, for keeping your credentials secure, and for all activity under your account. Tell us promptly at [email protected] if you suspect unauthorized use.

4. Connecting a server — your responsibilities

By connecting a Discord server to the Service, you represent that:

  • you administer that server (or are authorized by its owner) and have the authority to enable analytics on it;
  • your use complies with Discord’s Terms of Service and applicable law, including any obligation to inform your members that their activity is being analyzed; and
  • you will handle the resulting analytics responsibly and not use them to harass, discriminate against, or unlawfully profile individuals.

As between you and us, you are the operator of your community and are responsible for your lawful basis to analyze it. We provide the tooling; you decide how to use the output.

5. Acceptable use

You agree not to:

  • use the Service to break the law, infringe rights, or violate Discord’s terms;
  • connect servers you are not authorized to analyze, or attempt to access another customer’s workspace or data;
  • probe, scan, overload, reverse-engineer, or disrupt the Service or its infrastructure; or
  • resell or sublicense the Service without our written permission.

6. Plans, billing & cancellation

Some features may require a paid plan or credits. Where you purchase a paid plan, you authorize us (through our payment processor) to charge the applicable fees, including any recurring renewal until you cancel. Fees are stated at the point of purchase and exclude taxes unless stated.

You can cancel at any time; cancellation stops future renewals and takes effect at the end of the current billing period. Where you are a consumer in the EU/EEA or UK, you may have a statutory right to withdraw from a purchase within 14 days — but by starting to use a paid digital service immediately you may be asked to acknowledge that this right ends once performance has begun. Except where the law requires otherwise, fees already due are non-refundable. Contact [email protected] for billing questions.

7. Intellectual property & your data

We and our licensors own the Service and all related software and materials. We grant you a limited, non-exclusive, non-transferable right to use the Service while these Terms are in effect. You retain rights in the data you connect; you grant us the rights needed to process it to provide the Service, as described in the Privacy Policy.

8. Third-party services

The Service depends on Discord and other third parties. We are not responsible for their acts, outages, or changes to their terms or APIs, which may affect the Service. Your use of Discord remains subject to Discord’s own terms.

9. Disclaimers

The Service is provided “as is” and “as available” without warranties of any kind, to the fullest extent permitted by law. Analytics, including moderation and toxicity signals, are automated estimates and may be wrong; you are responsible for any decision you make based on them. We do not warrant that the Service will be uninterrupted or error-free.

10. Limitation of liability

To the fullest extent permitted by law, we are not liable for indirect, incidental, special, consequential, or punitive damages, or for lost profits, revenue, data, or goodwill. Our total liability arising out of or relating to the Service is limited to the amount you paid us for the Service in the 12 months before the event giving rise to the claim. Nothing in these Terms limits liability that cannot be limited by law.

11. Indemnification

You will indemnify and hold us harmless from claims and costs arising out of your misuse of the Service, your breach of these Terms, or your violation of law or third-party rights (including connecting a server you were not authorized to analyze).

12. Suspension & termination

You may stop using the Service and close your account at any time. We may suspend or terminate access if you breach these Terms, if required by law, or to protect the Service or other users. On termination, your right to use the Service ends; the sections that by their nature should survive (e.g. §§7, 9–11, 14) survive.

13. Changes

We may update the Service and these Terms. If we make material changes we will update the date above and give reasonable notice. Continued use after changes take effect means you accept the updated Terms.

14. Governing law & disputes

These Terms are governed by the laws of Ukraine, without regard to conflict-of-laws rules, and disputes are subject to the competent courts of Ukraine — except where mandatory consumer-protection law in your country of residence gives you the right to bring proceedings, or be sued, locally.
